Terms of Sale
Art. 1 - General Provisions
- By navigating this area, the user accesses the official sale of the Andia Fora and Patrizia Bonfanti brands through the URL: www.dovershop.us, a site exclusively owned by the company:

Browsing and transmitting a purchase order on the site implies acceptance of the Conditions and Data Protection Policies adopted by the site itself, as indicated therein.

These General Terms and Conditions of Sale, in accordance with the provisions of Part III, Title III, Chapter I, Consumer Code (Legislative Decree no. 206/05 amended by Legislative Decree no. 21/14 and Legislative Decree 70/03), apply to the sale of products with exclusive reference to purchases made on the Calzaturificio Dover S.r.l. owned site.

Before accessing the products provided by the site, the user is required to read these General Terms and Conditions of Sale, which are generally and unequivocally accepted at the time of purchase.

Users are encouraged to download and print a copy of the purchase form and these General Terms and Conditions of Sale, the terms of which the shoe factory reserves the right to unilaterally modify without prior notice.
Art. 2 - Subject

These General Terms and Conditions of Sale govern the offer, transmission, and acceptance of purchase orders for products on www.dovershop.it and do not govern the provision of services or the sale of products by subjects other than the seller who are present on the same site through links, banners, or other hypertext links.

Before placing orders and purchasing products and services from different subjects, we suggest checking their sales conditions.
Art. 3 - Conclusion of the contract

To conclude the purchase contract, it will be necessary to fill out the electronic form and transmit it following the relevant instructions.

It contains a reference to the General Terms and Conditions of Sale, images of each product and its price, the means of payment that can be used, the delivery methods of the purchased products, and the related shipping and delivery costs, a reference to the conditions for exercising the right of withdrawal, methods, and times for returning purchased products.

Before concluding the contract, you will be asked to confirm that you have read the General Terms and Conditions of Sale including the Information on the right of withdrawal and the processing of personal data.

The contract is concluded when the seller receives the form filled out by the user, after verifying the correctness of the data contained therein.

The buyer will be obliged to pay the price from the moment the online order forwarding procedure is concluded. This will happen by clicking on the "pay now" button at the end of the guided procedure.

Once the contract is concluded, the seller takes charge of the order for its processing.
Art. 4 - Registered Users

In completing the registration procedures, the user agrees to follow the instructions on the site and to provide their personal data correctly and truthfully.

Once registration is completed, the user will receive a confirmation email at the email address provided. Confirmation must be communicated within 24 hours at the latest. After this period, in the absence of confirmation, the seller will be released from any obligation towards the user.

Confirmation will in any case release the seller from any responsibility regarding the data provided by the user. The user undertakes to promptly inform the seller of any changes to their data communicated at any time.

If the user provides incorrect or incomplete data or if there is a dispute by the interested parties about the payments made, the seller may choose not to activate or suspend the service until the relevant shortcomings are rectified.

On the occasion of the first request to activate a profile by the user, the seller will assign a username and password to the user. The user acknowledges that these identifiers constitute the validation system for user access to the Services and the only system suitable for identifying the user, and that the acts performed through such access will be attributed to him and will be binding on him.

The user undertakes to keep their access data confidential, to handle them with due care and diligence, and not to temporarily transfer them to third parties.
Art. 5 - Product Availability and Inability to Deliver to the Recipient's Address

Product availability refers to the actual availability at the time the buyer places the order. This availability must however be considered purely indicative because, due to the simultaneous presence on the site of multiple users, products may be sold to other customers before the order is confirmed.

Even after sending the order confirmation email, cases of partial or total unavailability of goods may occur. In this eventuality, the order will be automatically corrected with the elimination of the unavailable product, and the buyer will be immediately informed via email, with Calzaturificio Dover S.r.l. proceeding to fulfill the purchase proposal only for the available Products.

Similarly, the order will be canceled in case of impossibility to deliver to the buyer's address, due to the unavailability of the delivery service used by the seller.

In cases referred to in the preceding points 2 and 3 of this article, Calzaturificio Dover S.r.l. will refund the amount paid, relating to the unavailable product or the undeliverable delivery, within 7 days from the moment it becomes aware of the unavailability of the product or the impossibility of delivery.
Art. 6 - Offered Products

- men's and women's shoes under the Patrizia Bonfanti and Andiafora brands.

Art. 7 - Payment Methods and Prices

The price of the products will be the one indicated from time to time on the site, unless there is an obvious error.

In case of error, the seller will notify the buyer as soon as possible, allowing confirmation of the order at the correct amount or cancellation. In any case, Calzaturificio Dover S.r.l. will not be obliged to provide what was sold at the erroneously indicated lower price.

The prices on the site include VAT and may change at any time. Changes do not affect orders for which an order confirmation has already been sent.

Once the desired products have been selected, they will be added to the cart. Simply follow the instructions for purchase, entering or verifying the information required at each step of the process. Order details can be modified before payment.

Payment can be made via: PayPal, Credit cards.
Art. 8 - Delivery

Calzaturificio Dover S.r.l. ships worldwide, provided that the delivery address is reachable by the shipping service used by the company itself.

Calzaturificio Dover S.r.l. only delivers to the user's home address provided at the time of purchase.

Delivery is generally made within 2-3 working days for Italy or within the normal delivery times of the carriers for abroad. If no delivery date is specified, it will be made within the estimated period at the time of selecting the delivery method and, in any case, within a maximum of thirty days from the date of confirmation, exclusively for Italy.

If delivery is not possible, the order will be sent to the warehouse. In this case, a notice will specify the location of the order and the methods for arranging a new delivery.

If the buyer is unable to be present at the delivery location at the scheduled time, they must contact the seller again to arrange a new delivery date.

If delivery cannot take place due to reasons not attributable to us, after thirty days from the date on which the order is available at our warehouses, we will assume that the contract is intended to be terminated.

In the event of termination, the amounts will be refunded net of transport costs within 7 days from the date of termination of the contract.

Shipping costs are borne by the buyer and are as indicated below ordered by place of shipment, unless expressly indicated at the time of order. In particular, for delivery to: Europe: 20.00 euros, USA / Far East: 50.00 euros, Other countries: 90.00 euros
The above costs do not include any customs duties.
Art. 9 - Transfer of Risk and Resolution in Case of Non-Payment
- The risks related to the products will pass to the buyer from the moment of delivery. If for any reason the payment due for the purchase of the goods, including shipping costs, does not succeed or is not made, within 24 hours from the submission of the order (sending by the customer of the form referred to in art. 3), the sales contract is terminated by law pursuant to art. 1456 of the Italian Civil Code, thereby relieving the obligation to deliver the goods.
Art. 10 - Warranty and Commercial Compliance

The seller is responsible for any defects in the products offered on the site, including the non-conformity of the items to the products ordered, in accordance with the provisions of Italian law.

If the buyer has entered into the contract as a consumer, i.e., any natural person who acts on the site for purposes unrelated to the entrepreneurial or professional activity possibly carried out, this warranty is valid provided that the defect occurs within 24 months from the date of delivery of the products; that the buyer makes a formal complaint about the defects within a maximum of 2 months from the date on which the defect was recognized by the buyer; that the online return form is correctly filled out.

In case of non-conformity, the buyer who has entered into the contract as a consumer is entitled to restore the conformity of the products without charges, through repair or replacement, or to obtain an appropriate price reduction or the termination of the contract concerning the contested goods and the consequent return of the price.

All return costs for defective products will be borne by the seller.
Art. 11 - Withdrawal

In accordance with current legal provisions, the buyer has the right to withdraw from the purchase without any penalty and without specifying the reason, within 14 days from the date of receipt of the products, pursuant to art. 57 of Legislative Decree 206/2005 starting from the date of receipt of the products.

In the case of multiple purchases made by the buyer with a single order and delivered separately, the 30-day period starts from the date of receipt of the last product.

The user who intends to exercise the right of withdrawal from the purchase can send an email, indicating the order number and user's name, to: sales@dover.it.

The buyer must also exercise the right of withdrawal by sending any explicit statement containing the decision to withdraw from the contract or alternatively by sending the standard withdrawal form, provided for in Annex I, Part B, Legislative Decree 21/2014, which is not mandatory.

The goods must be returned to:
Calzaturificio Dover S.r.l., Via Walter Tobagi No. 4, 56022 Castelfranco di Sotto, (PI), Italy.

The goods must be returned intact, in the original packaging, complete in all its parts, and complete with the attached tax documentation. Subject to the right to verify compliance with the above, Calzaturificio Dover S.r.l. will refund the amount of the products subject to withdrawal within a maximum period of 7 days.

As provided for in art. 56 paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, Calzaturificio Dover S.r.l. may suspend the refund until receipt of the goods or until the buyer demonstrates that he has returned the goods.

The right of withdrawal does not apply in the case where Calzaturificio Dover S.r.l. services and products are included in the categories of art. 59 of Legislative Decree 206/2005.

Calzaturificio Dover S.r.l. will carry out the refund using the same payment method chosen by the buyer at the time of purchase. In the case of payment made by bank transfer and if the buyer intends to exercise their right of withdrawal, they must provide the bank details: IBAN, SWIFT, and BIC necessary for the refund.
Art. 12 - Data Processing
- Buyer's data are processed in accordance with the provisions of the legislation on the protection of personal data, as specified in the specific section containing the information pursuant to art. 13 Legislative Decree 30 June 2003, no. 196, and art. 13 EU Regulation 2016/679 (Privacy Policy).
Art. 13 - Safeguard Clause
- In the event that one of the clauses of these General Terms and Conditions of Sale is null and void for any reason, this shall not in any way affect the validity and compliance of the other provisions contained in these General Terms and Conditions of Sale.

Art. 15 - Applicable Law and Competent Court

These General Terms and Conditions of Sale are governed by Italian law and interpreted in accordance with it, without prejudice to any different prevailing mandatory rule of the country of habitual residence of the buyer. Consequently, the interpretation, execution, and resolution of these General Terms and Conditions of Sale are subject exclusively to Italian law.

Any disputes relating to and/or resulting from them must be resolved exclusively by the Italian judicial authority. If the buyer is a Consumer, any disputes must be resolved by the court of the place of domicile or residence of the same in accordance with the applicable law. Where the buyer is not domiciled in Italy and there is no mandatory rule governing the consumer's jurisdiction, or where the buyer is not a consumer, for any dispute relating to the conclusion, execution, interpretation, as well as the possible termination of the sales contract, the exclusive jurisdiction is that of Pisa, excluding any other exclusive or concurrent jurisdiction.
Art. 16 - Final Clauses The Italian language version of this agreement is the only one deemed authentic as the original text.
